  1. Scope

These Terms of Service apply to all orders and services offered via shop.sbam.rocks.

By placing an order or purchasing tickets, you agree to these Terms. Mandatory consumer protection laws of your country of residence remain unaffected.

  1. Contracting Parties

Shop products and merchandise contracts are concluded with:

Both entities act as independent contracting parties for their respective services.

  1. Conclusion of Contract

Product listings do not constitute a binding offer. By placing an order, the customer submits a binding purchase offer.

We may accept or reject orders at our discretion. Contract acceptance occurs upon shipping confirmation or delivery.

We reserve the right to cancel orders in cases of pricing errors, stock errors, suspected fraud, or technical mistakes.

  1. Prices and Payment

All prices are listed in EUR unless stated otherwise.

Shipping costs, taxes, and fees are shown at checkout.

Payment must be completed using the offered payment methods. Orders may be canceled if payment is not received within a reasonable time.

  1. Shipping and Delivery

Shipping is handled by third-party carriers. Delivery times are estimates only unless explicitly agreed otherwise.

Risk transfers according to applicable consumer law. For business customers, risk passes upon handover to the carrier.

Delays caused by carriers, customs, force majeure, or events outside our control do not create liability to the extent permitted by law.

  1. Returns and Withdrawal (Goods)

EU consumers have a statutory 14-day withdrawal right unless a legal exclusion applies.

Returned items must be unused and in original condition.

Return shipping costs are borne by the customer unless legally required otherwise.

Personalized and custom-made products are excluded from withdrawal where legally permitted.

  1. Exchanges

Exchanges are voluntary and subject to availability. There is no automatic right to exchange.

  1. Event Tickets (SBAM Fest)

Event tickets are excluded from the EU withdrawal right for leisure events with fixed dates.

Tickets are non-refundable unless required by mandatory law.

The Event Organizer may reschedule, modify, or cancel events. Remedies may include replacement dates, partial refunds, or alternatives where legally required.

Events take place rain or shine. Line-up changes do not justify refunds.

  1. Use of Website

Users agree not to misuse the website, interfere with systems, attempt unauthorized access, or use automated extraction tools.

We may restrict or block access in case of violations.

  1. Intellectual Property

All content, artwork, logos, and media are protected by copyright and trademark law.

Use without prior written permission is not allowed unless legally permitted.

  1. Liability Limitation

To the extent permitted by law, liability is limited to intent and gross negligence.

No liability for indirect damages, lost profits, or consequential damages.

No liability for carrier faults or technical interruptions.

Nothing excludes mandatory consumer rights or liability for personal injury.

  1. Force Majeure

We are not liable for failure or delay caused by events beyond reasonable control, including natural disasters, strikes, government orders, epidemics, transport failures, or supply chain disruptions.

  1. Fraud and Order Screening

We reserve the right to refuse, hold, or cancel orders where fraud risk, abuse, or suspicious activity is detected.

  1. Data Protection

Data processing is governed by the Privacy Policy published on the website.

  1. Governing Law

Austrian law applies, excluding conflict-of-law rules, unless mandatory consumer protection law provides otherwise.

  1. Severability

If any provision is invalid, the remaining provisions remain in effect. The invalid clause is replaced by the closest lawful equivalent.

  1. Updates

We may update these Terms at any time with future effect. The version published on the website applies.
